These Terms of Service (“Terms”) govern your access to and use of Splintr and related services provided by Dreamgazer Audio LLC (“Dreamgazer Audio,” “we,” “us,” or “our”), including our website, web app, and related content (collectively, the “Services”).

1. Eligibility and Accounts

You represent that you have the rights needed to submit User Content and that it does not violate law or third-party rights.
4. Generated Output
The Services may generate audio or other outputs based on your inputs.
As between you and Dreamgazer Audio, and to the extent permitted by law, you may use generated output for lawful purposes, subject to these Terms and any third-party rights that may apply.
You are responsible for reviewing and determining whether generated output is appropriate for your intended use.
5. Payments, Subscriptions, and Refunds
Some features may require payment or a subscription. Pricing and billing terms are presented at checkout.
Payments are processed by third-party payment providers (e.g., Stripe), and your use of payment services is subject to their terms.

6. Intellectual Property

10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DREAMGAZER AUDIO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless Dreamgazer Audio and its affiliates, officers, employees, and agents from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your User Content, or your violation of these Terms or applicable law.

We may suspend or terminate your access at any time, including for violation of these Terms, legal requirements, or protection of the Services and users.
Sections that by nature should survive termination (including ownership, disclaimers, limitations of liability, indemnification, and dispute terms) will survive.
